Litigation in California: What Every Business Needs to Know

“The Golden State” remains the largest economy of any state in the nation, at $1.75 trillion in 2012. California also leads the nation with 54 companies on the Fortune 500 list (up one from last year) and 24 of Fortune’s 100 Fastest Growing companies. The state continues to receive close to half of all venture capital financing in the United States and is number one for attracting foreign direct investment.

Despite reasons for optimism in California’s improving economy, it remains a difficult state in which to conduct business in terms of regulation and litigation exposure.  More than one million lawsuits are filed in California each year.

To give General Counsel and corporate executives a high-level view of some unique issues they may face when doing business in the state, the McKenna Long & Aldridge LLP 2014 California Litigation Guide provides a glimpse into a wide variety of key subject areas. The focus of the articles in the Guide range from specific industry topics like insurance bad faith litigation, to topics which have broader application, such as California’s unfair competition law and water quality enforcement. Still other articles, like the “mixed motive” defense in employment discrimination cases and class actions under the Telephone Consumer Protection Act, cover specific topics that are developing quickly.

In all, the subjects highlighted in the Guide are those we believe to be some of the most important for businesses to be aware of during the coming year and beyond.

Articles include:

  • California’s Unfair Competition Law: Not Just Another Cost of Doing Business in California
  • California Water Quality Enforcement Litigation (or One More Way to Get Busted in California)
  • Employment Discrimination: A Mixed Bag for the “Mixed Motive” Defense
  • “Clear and Conspicuous” Consent Now Required Under TCPA
  • Insurance Bad Faith Litigation: Developments Concerning the Duty to Settle.
