The Final Overtime Rule is Out:
What Employers Must Do Before December to Comply
On May 18, 2016, the U.S. Department of Labor (“DOL”) released its Final Rule amending the Fair Labor Standards Act’s (“FLSA”) white collar exemptions. The Final Rule increases the minimum salary threshold level in order to qualify an employee as exempt from overtime from $23,660.00 to $47,476.00. There is no doubt that this change in salary will dramatically increase the number of workers who will now qualify for overtime pay, forcing every employer in the country to carefully assess how to handle the additional financial burden. The Rule takes effect on December 1, 2016; accordingly, every employer should start evaluating their options and transitioning their workforces now to ensure that the requirements of the Final Rule are implemented in a compliant and effective manner. Indeed, it may take multiple attempts to find a new and feasible workforce structure.
In this webinar, we will discuss the new salary threshold and impact on all employers, including what steps employers can and should be taking to ensure compliance before December.
