FEDERAL SUPREME COURT (“SUPERIOR TRIBUNAL FEDERAL – STF”) – “ADI” 5794 – MANDATORY UNION CONTRIBUTION
On last Friday (June 29th, 2018), by a majority, the Federal Supreme Court decided for the constitutionality of the point of the Labor Reform that extinguished the obligation of the union contribution, this decision put an end to the lawsuit and more 19 other cases which walked together.
Among other reasons, most of the ministers had understood that it is not possible to admit that the union contribution is imposed on workers and employers when the Constitution states that no one is obliged to join or maintain joined to a union.
