Presidential Decree Number 4.445: Strategic materials subject to recycling

On February 24th, 2021, Presidential Decree Number 4.445 was published in the Special Official Gazette Number 6.617, whereby the Presidency declares all iron, aluminum, copper, bronze, steel, nickel and other metal waste to be designated as of “strategic importance for the development of the national economy”. This designation also covers all naval, aeronautic, electric and electrical junk, in any condition, as well as the non-metal solid residues, fiber optics and secondary fibers which result from the recycling process of paper and cardboard. These materials are collectively known as “strategic materials subject to recycling” (article 1).
The Ecosocialist Corporation Ezequiel Zamora (CORPOEZ) is designated as the institution responsible for the control, collection, gathering, mobilization, transformation, commercialization and export of the material in question (article 3).
As such, exports of the designated materials are therefore prohibited unless under the express and “exceptional” authorization of the Executive Vice-President (article 8). The Public Ministry is tasked with taking the necessary measures to detect, prevent, control and combat practices that go against the provisions stated in this Decree (article 9).
This Decree entered into legal force on February 24th, 2021, the day it was published in the Official Gazette (article 13).
