French legal flexibility

Litigation dates and deadlines expired during the health emergency period in France are fully adapted due to the Covid-19 epidemic. A prescription extends those who end between March 12, 2020 and 1 month after the end of the state of health emergency, that is, until June 24, 2020.

The provisions are as follows:

  • barring exceptions, the deadlines are extended by 2 months following the end of this period for:

o the procedures: appeal, legal action, formality, registration, declaration;

o administrative or jurisdictional measures: prohibition, authorization, permit, approval, assistance …

  • periodic penalty payments take effect from the end of a period of 1 month following the end of this period;
  • the response times of the administrations are interrupted until the end of this period mainly in procedures where the silence of the administration implies acceptance;
  • the deadlines imposed by the administration to carry out an inspection, work, or to comply with a rule are interrupted until the end of this period, with exceptions;
  • the receivables recovered by the Treasury are suspended until the end of a period of 2 months following the end of this period. Do not benefit from a postponement, the deadlines: • applicable in criminal matters, criminal procedure; • applicable in matters of elections governed by the electoral code (deadline for voting prohibition, appeal, etc.); • supervising custodial measures; • concerning the procedures for registering for a public service access route or for training in an educational establishment; • relating to the related financial obligations and guarantees mentioned in Articles L. 211-36 et seq. Of the Monetary and Financial Code; • set out in the agreements concluded within the framework of a payment system and settlement and delivery systems for financial instruments mentioned in article L. 330-1 of the same code; • the deadlines and measures implemented in application of the emergency law to deal with the epidemic. Do not benefit from a postponement, the deadlines:

  • applicable in criminal matters, criminal procedure;
  • applicable in matters of elections governed by the electoral code (deadline for voting prohibition, appeal, etc.);
