IPR Enforcement: Road Milling Machines, Arrowheads, Jump Ropes

Road Milling Machines. The International Trade Commission has terminated patent infringement investigation 337-TA-1067 of road milling machines and components thereof with respect to numerous patent claims based on complainant Wirgen America Inc.’s withdrawal of those claims.

Arrowheads. In investigation 337-TA-1033 the ITC has issued a general exclusion order prohibiting the unlicensed importation of arrowheads with arcuate blades and components thereof covered by one of the patents at issue. Infringing goods may enter the U.S. under a 100 percent bond during the 60-day period the president has to review this remedy.

Jump Rope Systems. The ITC has instituted investigation 337-TA-1108 to determine whether imports of jump rope systems are violating Section 337 of the 1930 Tariff Act by reason of patent infringement. The products at issue are jump ropes with handles that contain a bearing element that permits a shaft to more easily rotate.

Complainant Jump Rope Systems LLC requests that after this investigation the ITC issue a limited exclusion order, which would direct U.S. Customs and Border Protection to prohibit the entry of infringing products into the U.S., and a cease and desist order, which would require the named respondent to cease actions that violate Section 337, including selling infringing imported articles out of U.S. inventory. The respondent in this investigation is located in China.
