This seminar will look at how to deal with a business break up.
If you are in business with others (whether a limited company, an LLP or a partnership), the likelihood is that sooner or later one or more is going to want to leave. If everything is agreed and amicable, then there will be no problem. But how can you be sure in advance this is what will happen? There is the potential for serious disagreements in a business break-up and these can frequently do destroy the business entirely.
This seminar will look at what you can do in advance to protect yourselves and the business against a difficult break-up. Usually this will involve setting up a shareholders’ agreement, an LLP members’ agreement or a partnership agreement. We will review the main requirements to covered and how this can save a fortune in legal costs – and save the business.
We will also look at remedies that are available if a break-up happens, including rights of shareholders, members and partners, and the legal remedies that can be used, and when these can be excluded by an agreement.
You never think a business break-up is going to happen to you. But if it does, advance planning can save you and your business.
